Introduction
These Terms and Conditions of Use establish the rules for using AtomicPay, a payment intermediation solution owned by Atomicat Ltda. (CNPJ 47.164.113/0001-96). This document is the main agreement between AtomicPay and the user of the payment intermediation platform.
AtomicPay intermediates and facilitates payment solutions for Users, including Buyers and Sellers, enabling secure and efficient financial transactions. By using AtomicPay, the User agrees to these clauses and to the other documents that form part of the agreement.
Definitions
AtomicPay is the payment intermediation solution used to facilitate financial and payment transactions. User means the individual or legal entity that owns the Account and accesses AtomicPay domains or registers for account creation and verification.
Buyers are the parties that make payments for products or services offered on the platform. Seller is the party that offers products or services and uses AtomicPay to receive payments. Transaction means a financial operation carried out through the tool, including credit card, PIX, boleto or other accepted payment methods.
Account means the Payment Account created upon registration and owned by the User. Withdrawal means the transfer to a checking or savings account owned by the Account holder. Recurrence means automatic billing to Buyers' credit cards at intervals defined by the User.
Acceptance and incorporated documents
The agreement includes the AtomicPay Terms and Conditions of Use, the AtomicPay Privacy Policy and the AtomicPay Content Policy.
By creating an Account and being approved to process transactions through AtomicPay, the User declares that they have read and fully accepted all clauses and conditions of this Agreement and its incorporated documents.
AtomicPay may add new schedules or specific terms for current or future Services. The User will be informed, and continued use of the Services will imply acceptance of the new terms unless the User objects within the applicable notice period.
Purpose
AtomicPay provides electronic payment management services, including capture, processing, reconciliation, settlement and management of transactions made through multiple payment methods.
Through the AtomicPay Dashboard, the User can manage their wallet, check statements, future receivables and blocked amounts. AtomicPay acts as a payment intermediary between the User and Buyers and is not a financial institution, post-paid payment instrument issuer or payment arrangement institutor.
Registration and verification
To use the Services, the User must provide information such as full name or company name, CPF or CNPJ, address, email, phone number, bank account details owned by the User for withdrawals, and business activity type.
The User must keep registration data up to date and provide supporting documents when requested. AtomicPay may request additional information and verify the accuracy of the data provided.
If irregularities, inconsistencies, suspected fraud, regulatory breaches, or operational, reputational or financial risk are identified, AtomicPay may block the Account, limit features, retain balances or close the Account under the Agreement.
Payment processing
AtomicPay will settle payments processed due to the User's activity in their Account, after deducting the remuneration owed to AtomicPay.
After each payment, AtomicPay will update the transaction history in the AtomicPay Dashboard. The User must promptly report discrepancies, and AtomicPay may correct the transaction history whenever necessary.
In case of fraud or suspected fraud, the User must immediately notify AtomicPay and must not accept the presented payment method. AtomicPay may suspend, refuse processing or block transactions that violate the Agreement or applicable rules.
Fees
For the Services, the User agrees to pay AtomicPay a transaction fee on each transaction made between the User and Buyers, plus any withdrawal fees and other contractual charges.
Transaction and withdrawal fees will be charged through direct deductions from the Account. AtomicPay may adjust fees after prior notice to the User, observing the periods established in the Agreement.
Refunds, chargebacks, disputes and retention
The User must maintain clear cancellation and refund policies for Buyers. AtomicPay is not responsible for losses arising from returns, exchanges, cancellations of products or services, or lack of such policies.
The User states that they know the rules for commercial disagreement disputes and chargebacks. During disputes, related balances may be retained until final resolution.
AtomicPay may block amounts, retain future receivables, debit accounts and take collection measures when there is risk, breach of contract, suspected fraud, chargeback, MED, cancellation or losses caused by the User.
Term, changes, termination and liability
The Agreement is entered into for an indefinite term and becomes effective upon acceptance. AtomicPay may change the Agreement at any time and will notify the User when changes restrict rights or are materially relevant.
The User must use the AtomicPay Account in compliance with applicable law, payment intermediary rules, the Agreement and the Content Policy, refraining from illegal, abusive or morally improper acts.
AtomicPay acts only as a transaction intermediary and is not responsible for the User's products or services, their legality, delivery issues, defects, consumer obligations, commercial practices or advertising.
Data protection, anti-corruption and general provisions
By accepting the Agreement or using the Services, the User acknowledges that they collect and process personal data and declares that they are able to comply with the LGPD and AtomicPay's Privacy Policy.
The Parties declare that they know and comply with anti-corruption, anti-money laundering and counter-terrorism financing laws and undertake not to perform acts that violate applicable law.
The Agreement is governed by the laws of the Federative Republic of Brazil. The courts of São Paulo, State of São Paulo, are elected to resolve disputes arising from the Agreement.
